EVICTIONS

BACK TO MENU

The Coronavirus Act allows has made the following changes to the two notices to quit
Section 21 and Section 8 from March 25th to September 30th 2020

Note that all proceedings must now follow the Governments Pre Action Protocol.

The full protocol can be seen here, our summary here.

  1. Section 8 has been amended so that the minimum time to eviction will become 3 months for all grounds
  2. Section 21 is also amended to become a three month notice.

It is important to note that neither notices are being paused or stopped, merely the time to eviction being extended.

See the actual wording in Sections 6 and 7 of Schedule 29 of the actual Bill.  See also the confirmation here.

See also our news item that there might be an extension to this if too many landlords chase debts from tenants.

Note that any notices raised before March 25th are now SUSPENDED.

UPDATE MARCH 28TH

See the official advice regarding evictions, and the decision by the Master of the Rolls to stop all existing cases.

Note also that all landlords will now have to follow the Pre-action Protocol for Social Landlords.  See a useful summary from Bevan Brittan.
