NOTICES TO BE USED

It is important to use the correct notice, in the correct manner, else the tenant might be able to stay and the landlord will incur extra costs.

Notices to use for an AST

Section 21.  This is a 2 month notice, and It is important to note:-

Must use the prescribed form (form 6A);

ensure correct format – as specified on the form 6A;

cannot  be issued in the first 4 months of AST;

must be used within 6 months of issue;

tenants have statutory right to claim back any overpayment of rent;

(if required) must have valid:-

EPC;

gas safety inspection report;

Cannot be used:-

If deposit not protected;

Property not licensed where one was required.

must issue CLG booklet (advised start of tenancy)

Section 8

The length of notice varies depending upon the Ground to be used.

This notice has been altered, and is now form 3, please ensure you always use the latest version.

If seeking repossession on grounds of overdue rent, it is a advised you use 3 separate Grounds:-

Ground 8, whereby:-

Arrears must be at least:

8 weeks if rent paid weekly or fortnightly

2 months if paid monthly

1 quarter if rent paid quarterly

3 months if rent paid annually

Arrears must exist at both time of service of notice and time of the Court hearing

Mandatory ground

Ground 10: –

Some rent lawfully due from tenant at time of service of Section 8 notice and at time Court proceedings commenced

Discretionary ground

Ground 11: –

Tenant has persistently delayed in paying rent which has become lawfully due

No rent needs to be in arrears at time of the issue of proceedings

Discretionary ground

It is important to cut and paste the actual words for the Grounds into the Section 8.

For a non-AST a simple notice to quit can be used.  We would recommend talking to the Help Line about this.
